Delhi HC stays summons in fake Input Tax Credit case

New Delhi, Apr 4 (UNI) The Delhi High Court has stayed the Summons in a fake Input Tax Credit (ITC) case.

A division bench of Justices Rajiv Shakdher and Talwant Singh was hearing the case of one Ankit Bindal, who has been challenging the summons issued by CGST North Delhi.

Advocate Ruchir Bhatia, appearing for the petitioner, argued that the summons have been issued to the petitioners which are not only vague but also seek self-incriminating material from them.

The Central Goods and Services Tax (CGST) has been issued the summons on the ground that the petitioners’ to produce documents and records for the period from date of GST registration to till date.

The petitioner said, in the summons, bank statements have been called for without specifying the relevant period for which the same need to be furnished.

Besides this, the petitioners have been called to tender voluntary statement.

The bench listed the matter on April 12, 2021.
